A subpoena is a document that orders a named individual to personally appear at a trial or hearing to:
1) give testimony (known as a Subpoena Ad Testificandum) or
2) to produce documents or objects to be used at a trial or hearing as evidence (known as a Subpoena Duces Tecum).
​Subpoena Ad Testificandum – Use this subpoena when an individual's testimony at a trial or hearing is needed.
Subpoena Duces Tecum – Use this subpoena when an individual's appearance and production of documents or other objects are needed at a trial or hearing.

All orders received by our office are logged into our system right away and sent out for service immediately.

If our process servers encounter any unusual situations, they will document everything, taking pictures if necessary and provide you with the pertinent information.
Average turn around time is 2 to 7 days on routine service of process. Your proof of service of service is promptly completed and returned to you or the court.
We offer Deposition Officer services. From preparation to record retrieval, your discovery will be processed timely and thoroughly.​​​​
​The following items are required to properly serve subpoenas to the Department:

All state court subpoenas require a check for $15.00 made out to the Department of Health Care Services. The Subpoena Center portal will not have a method of processing payments. After entering your service request in the GovQA platform, checks for processing your service (with the associated GovQA reference number in the memo line) should still be mailed to the Department as normal. Your requests will be processed as soon as the payment is received. Please mail the original check with the associated Subpoena Center/GovQA reference number in the memo line to the Department at Department of Health Care Services, Office of Legal Services, Subpoena Desk, P.O. Box 997413, MS 0010, Sacramento, CA 95899-7413. If payment is not received within (five) 5 business days, service will be rejected.

State court subpoenas require a Notice to Consumer with a date no sooner than ten (10) days from the date of service, or an Authorization to Release Records.

State court subpoenas for personal attendance of custodian of records require a check for $275.00 made out to the Department of Health Care Services.

All subpoenas must have a Date of Birth, complete Social Security Number, or CIN (13 or 14 digit number with a letter in the middle; or first nine digits).

Federal court subpoenas do not require a check.

Authorization to Release Records must include:

Copy of current, legible photo.

If representative, evidence of the representative relationship (e.g. appointment of guardian ad litem or birth certificate).

Deposition Officer Services: We offer the service of handling your subpoena needs with speed and efficiency. Our team is comprised of experienced professionals who know how to effectively deal with custodians to make sure that your records are received. We can act as Deposition Officer for subpoenas served by our office, follow up with facilities to ensure we meet your deposition deadlines, and maintain your subpoenaed records according to the civil code of procedure.

Medical and Business Records Subpoena Services: We can prepare your subpoena, notice opposing counsel by sending the Notice to Consumer or Notice of Taking Depositions, serve the Subpoenas on all Custodians, and act as your deposition officer.

According to CA law, any out-of-state counsel who takes part in litigation outside of California does not need to initiate any court process in California; therefore, the out-of-state attorney only needs to return counsel in California and give him/her a copy of the out-of-state subpoena. The CA version of the model act can be found at Cal. Civ. Code 2029.100, et seq. After that, a California lawyer may subpoena an out-of-state recipient just by serving a California subpoena form, along with the out-of-state subpoena, on the California subpoena recipient.

​Effective January 1, 2010, new laws and mandatory forms relating to service of Subpoenas in California for cases pending in states other than California.
Please see applicable filing fees and a list of the mandatory forms with a link to the California Judicial Council website where the forms may be found and filled in online.
Service rules and completion dates of service for the subpoenas may be different from the requirements of your state and the necessary California Subpoena forms need to be filled out accurately.

$45.00 filing fee, payable to “Superior Court.”

Copy of the issued foreign subpoena from the other state.

Completed Application on the Mandatory Form, SUBP-030.

Completed Mandatory California Subpoena,
SUBP-035, SUBP-040, SUBP-045 or SUBP-050. -
A $15.00 witness fee is required at the time of service for all Production of Business Records subpoenas in California.

All Personal Appearance Subpoenas are entitled to witness fees in the state of California.
